1. Introduction
Welcome to LockedIn ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website, and related services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the Platform immediately. We may update these Terms from time to time, and continued use after changes are posted means you accept the revised version.
2. Eligibility and Account Registration
You must be at least 13 years old (or the minimum age required by your country's laws) to use the Platform. If you are under the legal age of majority, you must have your parent or guardian's permission to use the Platform and agree to these Terms on your behalf. When you create an account, you must provide accurate and up-to-date information, maintain the confidentiality of your login credentials, and are responsible for all activities that occur under your account. You may not sell, transfer, or assign your account or any account rights. We reserve the right to disable or terminate any account that violates these Terms or if we believe your activity may harm the Platform or other users.
3. User Content and Rights Granted
You retain ownership of the photos, videos, messages, and other content ("User Content") that you post or share on the Platform. However, by submitting, posting, or displaying User Content, you grant LockedIn a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, use, reproduce, modify, adapt, distribute, publish, and display that content in connection with the Platform's operation and improvement, including promoting and redistributing part or all of the Platform in any media format. This license continues for as long as your content remains on the Platform. You confirm that you have all necessary rights to grant this license and that your content does not infringe or violate any third-party rights or laws.
4. Community Guidelines and Prohibited Conduct
We are committed to fostering a safe and positive environment. You may not post or share content that contains hate speech, threats, sexual exploitation, nudity involving minors, graphic violence, bullying, harassment, or any illegal activity. You may not use the Platform to impersonate others, spam users, collect information without consent, or manipulate engagement (such as fake likes or followers). You must not interfere with, disable, or disrupt any security features or servers. We reserve the right to remove any content, suspend accounts, or take legal action if we determine your conduct violates these Terms or our Community Guidelines.
5. Child Safety Policy
The safety and privacy of minors are a core priority. The Platform is not directed to children under the age of 13, and those under 13 are prohibited from creating accounts. If we become aware that a child under 13 has provided us with personal information, we will promptly delete that information and terminate the associated account in compliance with applicable child protection laws, including the Children's Online Privacy Protection Act (COPPA) where applicable. For minors over 13 but under the age of majority, we may implement special protections, including restricted content visibility, limited messaging functions, and enhanced privacy defaults. Parents or guardians who believe their child has created an account in violation of these Terms may contact us at support@lockedin.support for assistance. We encourage parents to actively monitor their children's online activity and to report any misuse immediately.
6. Intellectual Property
All intellectual property rights in and to the Platform, including its name, logo, software, text, design, and graphics, are owned by or licensed to LockedIn. Except as permitted by these Terms, you may not copy, modify, distribute, create derivative works, or exploit any portion of the Platform without prior written consent. You may not use our trademarks, branding, or logos in a way that suggests endorsement without permission.
7. Privacy and Data Usage
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share information when you use the Platform. By using the Platform, you consent to the collection and use of information as described in our Privacy Policy, including the transfer of information to servers located in other countries where we or our service providers operate.
8. Payments and In-App Purchases
Some features of the Platform may require payment. By purchasing or subscribing to paid services, you agree to pay all applicable fees as displayed at the time of purchase. All transactions are processed through third-party payment providers, and we are not responsible for their errors or security. Unless otherwise required by law, all payments are non-refundable. We reserve the right to change prices or introduce new charges with notice where required by law.
9. Termination and Account Suspension
We reserve the right to suspend or terminate your account at any time and without notice if we reasonably believe that you have violated these Terms, created risk or possible legal exposure for us, or if we are required to do so by law. You may delete your account at any time by following the instructions within the Platform. Upon termination, your license to use the Platform will immediately end, though certain provisions (such as intellectual property, liability, and indemnification) will continue to apply.
10. Disclaimers
The Platform and all content, materials, and features are provided "as is" and "as available," without any warranties of any kind, whether express or implied. We do not guarantee that the Platform will always be safe, secure, or error-free, or that it will function without disruptions or delays. Your use of the Platform is at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law, LockedIn and its affiliates, employees, directors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses arising from your access to or use of the Platform, even if we have been advised of the possibility of such damages. In no event shall our total liability exceed the amount you have paid to us, if any, in the twelve months preceding the event giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless LockedIn, its affiliates, and their officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Platform, your User Content, or your violation of these Terms or applicable law.
13. Modifications and Updates
We may modify or update these Terms periodically to reflect changes in our practices or for other operational, legal, or regulatory reasons. The updated Terms will be posted on the Platform with a new "Last Updated" date. If you continue to use the Platform after the new Terms take effect, you agree to be bound by them.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States, without regard to its conflict of law rules. Any dispute or claim arising out of or in connection with these Terms or your use of the Platform shall be resolved exclusively in the courts of the United States, unless otherwise required by applicable law. You may not use this app/service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
